A Misguided Missguided
Earlier this month, the mother of four won a lawsuit against Missguided, a UK-based fashion brand her team had sued for selling knock offs of her outfits.
With the huge fan base Kim has all around the world, Missguided must have been sure that associating their products with her would translate in a boost in sales. And it did for a while, until the lawsuit happened.
Missguided, though headquartered in Manchester, UK, has an arm in the United States, and this specific branch was the one Kim had a problem with. Despite suing them, the company did not bother to respond to Kim’s objection, leaving the judge with little choice but to rule in favor of Mrs. West.
Judge Philips awarded Kim Kardashian $2.7 million in damages, plus an additional $59,000 to cover the legal costs she accrued. It must have been a pretty straightforward case, no?
In addition to the $2 million, the judge also ruled against Missguided using any of Kim’s trademarks in whichever way, be it the marketing, sale, or the distribution of their fashion products.
It just doesn’t seem fair to earn millions at the expense of someone who worked so hard to make herself a household name, does it? The fair judge seems to totally agree with this fact.
Kim Kardashian’s lawsuit had been before the courts for some months, having been filed in February. The model accused Missguided of being in the same boat as multiple other fashion companies that are known for riding on the successes of celebrities.
That she won this case should serve as a warning to other companies using famous names (and without the individuals’ consent of course) to boost their sales. The law is watching!
According to the lawsuit, Missguided had established an elaborate and systematic scheme of using celebrity names when promoting their products.
As opposed to others who simply replicate looks identical to what celebrities wear on the red carpet or what they post on their social media pages, this specific company mentioned celebrity names and used their images in promotional products. Using Kim Kardashian, however, proved to be a costly mistake.
In February, Kim took to Instagram to post an image of herself in a gold dress. The caption that accompanied it was actually a warning to fashion companies, asking them to wait until she had worn the dress in public before knocking it off. You’d think that Missguided would have heard the warning bells, right?
But alas, they didn’t, or they chose to ignore their ringing. They soon uploaded an image of a model in the same exact dress, tagging Kim Kardashian while at it.
This must have infuriated her, and no wonder the lawsuit followed. Although they took down the post, they’ve still got to pay the $2.7 million they owe her!
